Washington State HOA WUCIOA Compliance Guide

The Washington Uniform Common Interest Ownership Act (WUCIOA), enacted through Senate Bill 5129 (SB5129), establishes binding compliance requirements for all Washington State HOAs and common interest communities. Phase 1 requirements are in effect now. Phase 2 full compliance is required by January 1, 2028.

Open Meeting Requirements

All board meetings must be open to homeowners. Written notice must be provided between 14 and 50 days in advance, including the date, time, location, and agenda.

Secret Ballot Requirements for Elections and Key Votes

Washington HOAs must use secret ballots for board elections, board member removals, and CC&R amendments. Incumbent board members cannot access or count ballots in any election in which they are a candidate.

This is one of the most technically demanding WUCIOA requirements - most email-based or informal voting systems cannot meet it.
